All content on this Site, including but not limited to images of art work, text, graphics, logos, and the art work itself, is the exclusive property of Jeremy Rogers and is protected by United States and international copyright laws.

Purchasing an original painting or print does not transfer the copyright, reproduction rights, or intellectual property rights to the buyer. We retain all rights to reproduce the art work in any form.
 

You may not reproduce, distribute, modify, or use images of the art work for commercial purposes without our express written consent.

Purchases and Payment

All prices are listed in USD and are subject to change without notice. The price of the art work does not include shipping, handling, or applicable taxes, which will be calculated at checkout.
 

We accept all major credit cards. Your order will not be processed or shipped until full payment has cleared.
 

We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies in product or pricing information, or suspected fraud.

Packaging, Handling, and Transit Insurance

Shipping original fine art requires meticulous care to ensure it arrives at your door in the exact condition it left the studio.
 

• Handling & Premium Packaging: A handling fee is built into the shipping cost to cover premium, archival-safe packaging materials. Because of the unique nature and formatting of my canvases, each piece is carefully wrapped using protective glassine, specialized edge cushioning, and heavy-duty, weather-resistant boxing to ensure maximum protection.
   

• Full-Value Insurance: For your peace of mind and mine, all original artwork is shipped with full-value transit insurance. In the highly unlikely event that a painting is damaged or lost in transit, this insurance ensures the investment is fully protected.

Returns and Refunds

We hope you love your new artwork. Please be advised that all sales are final, and we do not accept general returns or offer refunds. However, if your artwork arrives damaged during transit, please contact us immediately so we can make it right.

Limitation of Liability

To the fullest extent permitted by law, Darros Arthaus and Jeremy Rogers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of the Site or the purchase of art work. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid for the art work in question.

Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site after any changes indicates your acceptance of the new Terms.

Art work Depiction and Descriptions

We make every effort to display the colors, textures, and details of the art work as accurately as possible.

However, due to the nature of digital displays and the handmade quality of fine art, we cannot guarantee that your monitor's display will perfectly reflect the actual art work. Minor variations are normal and not considered defects.

Customs, Duties, and Import Taxes (International Orders)

When purchasing artwork from outside the United States, your order may be subject to import duties, customs taxes, or Value Added Tax (VAT) once it reaches your destination country.

• Buyer Responsibility: I do not collect or estimate these local fees at checkout. As the buyer and importer of record, you are solely responsible for paying any additional customs, duties, or taxes required by your local government to release the package.
   

• Customs Declarations and Delays: I am required by law to declare the full, accurate retail value of the artwork on all international customs forms and cannot legally mark items as "gifts" to bypass these fees. Please note that I am not responsible for any shipping delays caused by international customs processing.

Shipping and Risk
of Loss

We will carefully package and ship the art work to the address provided during checkout. Shipping times are estimates and cannot be guaranteed.
 

The risk of loss and title for the art work are passed to you upon our delivery to the shipping carrier. We recommend purchasing shipping insurance for high-value original paintings.
 

For international orders, the buyer is solely responsible for any customs duties, import taxes, or fees levied by the destination country.

Shipping Rate Calculation

To provide the most fair and accurate pricing, shipping rates are calculated based on the total weight and dimensions of the order.
 

• Weight Tiers: Rates are tiered to reflect the specialized packaging and handling required for different sizes of original work.
   

• Total Package Weight: The weight calculated at checkout includes the artwork, all protective archival materials, and the heavy-duty shipping container.
   

• Oversized Items: For exceptionally large pieces or those requiring custom wooden crates, shipping is handled as a separate freight quote to ensure the highest level of safety and the most competitive current market rate.

User Conduct

You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site. You may not attempt to gain unauthorized access to any portion of the Site or our systems.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Texas.
